Terms of Service

These Terms of Service ("Terms") govern your use of the YuvFlow web application ("Service") operated by YuvFlow ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Account Registration

  • You must provide a valid email address and accurate information when creating an account.
  • You may register using an email and password or by signing in with your Google account.
  • You are responsible for maintaining the security of your account credentials. Do not share your password with others.
  • You must be at least 16 years of age to use the Service.
  • You may only maintain one account per person. Creating multiple accounts to circumvent restrictions is prohibited.

2. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Violate any applicable laws, regulations, or third-party rights.
  • Upload or store malicious content, malware, or files intended to harm other users or systems.
  • Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure.
  • Interfere with or disrupt the Service, including through excessive automated requests, scraping, or denial-of-service attacks.
  • Use the Service to send spam, unsolicited messages, or abusive content.
  • Impersonate another person or entity.
  • Circumvent any rate limits, access controls, or security measures we implement.

3. Workspaces and Collaboration

  • You can create workspaces and invite others to collaborate. When you invite someone, they will receive an email invitation.
  • Workspace Owners have full control over the workspace, including managing members, roles, and deleting the workspace.
  • Content visibility: all processes, notes, and attachments within a workspace are visible to all members of that workspace, according to their role (Owner, Admin, Member, Viewer).
  • You are responsible for any content you create or upload to a workspace.
  • If you leave or are removed from a workspace, you will lose access to the content in that workspace. Processes you created in shared workspaces may be transferred to a workspace administrator.

4. Your Content

  • You retain ownership of all content you create or upload to YuvFlow, including processes, notes, and file attachments.
  • By using the Service, you grant us a limited license to store, display, and transmit your content solely to provide the Service to you and your workspace members.
  • We do not claim ownership of your content. We do not use your content for advertising, training machine learning models, or any purpose other than operating the Service.
  • You may export your workspace data at any time using the export feature.
  • You must not upload content that you do not have the right to share, or content that infringes on the intellectual property rights of others.

5. Notifications and Communications

  • The Service may send you email notifications (reminders, workspace invitations, email verification) and push notifications (if you opt in).
  • You can control notification preferences from your account settings, including disabling email digests and unsubscribing from push notifications.
  • Certain transactional emails (account verification, security alerts) are essential and cannot be disabled while your account is active.

6. Service Availability

  • We strive to keep YuvFlow available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
  • We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time, with or without notice.
  • We are not liable for any loss of data, revenue, or business opportunities arising from Service downtime.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

8. Account Suspension and Termination

  • We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service or other users.
  • If your account is suspended, you will not be able to log in or access the Service. You may contact us to appeal a suspension.
  • You may delete your account at any time. Upon deletion, your personal data and content will be removed in accordance with our Privacy Policy.
  • We reserve the right to delete accounts that have been inactive for an extended period, after providing notice to the registered email address.

9. Intellectual Property

  • The YuvFlow name, logo, design, and underlying software are the intellectual property of YuvFlow and are protected by applicable intellectual property laws.
  • You may not copy, modify, distribute, or reverse-engineer the Service or its components.
  • These Terms do not grant you any rights to use our trademarks, logos, or branding without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from your use of the Service.
  • Our total aggregate liability for any claims related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless YuvFlow and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective date" at the top of this page and may notify you by email or through the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you should stop using the Service.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to the competent courts of the jurisdiction where YuvFlow is established.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
